GARY | A woman who said a Gary City Jail correctional officer raped and beat her is suing Gary and several of its police officers, arguing they tried to cover up the 2007 incident.
Neither the alleged victim nor the accused officers are named in the Lake Superior Court lawsuit.
Assistant City Attorney Carl Jones said Friday that he is still unable to "pinpoint the identity of the (alleged) perpetrator or assistants that would have participated in the coverup."
To his knowledge, Jones said, no police officers have been removed from active duty.
"It's too early for me to really comment," he said.
Andrew Yoder, attorney for the alleged victim, said he won't file the officers' names until he receives reports from the city to confirm their identities.
Wendy Osborne, FBI special agent and media coordinator, confirmed Friday the FBI opened a civil rights investigation into the alleged incident at the Gary City Jail. That investigation is still pending, she said.
Jones said he was unaware of the FBI investigation but added the city would fully cooperate.
The lawsuit alleges officers violated the woman's rights, committed assault and battery, inflicted intentional emotional distress and were negligent in their duty, court records state.
The alleged victim was arrested late at night Aug. 31, 2007, and transported to the city jail, court records show. Yoder declined to say why his client was arrested.
The woman alleges an officer escorted her at 12:30 a.m. the next day from her cell to a room attorneys use to speak privately with prisoners. She said the officer raped her, then brought her back to her cell.
Gary officers rebuffed the woman's attempts to report the rape, records show.
Later, the woman was transported to the Methodist Hospitals Southlake Campus in Merrillville -- not to the hospital's Northlake Campus across the street from the city jail, records state.
The lawsuit says the accused officer was a part-time employee of the hospital's Northlake Campus and officers were trying to protect his identity.
The woman said she tried to commit suicide after officers brought her back to the jail, records state.
Two Gary detectives interrogated the woman on the psychiatric floor of the Lake County Jail, accusing her of fabricating the rape, records state. They threatened to file felony charges against her that would only be dropped if she dropped the rape allegation, records state.
The Gary City Jail closed in late 2008.
"She is dealing with this life-changing event and wants people to respect her privacy during this time," Yoder said.
