CROWN POINT | The legal battle over annexation between St. John and Dyer continued Tuesday.
Both sides presented arguments before Lake Superior Court Magistrate Michael Pagano regarding St. John's motion to dismiss an injunction that Dyer requested against a voluntary annexation St. John approved in October, St. John Town Manager Steve Kil said.
Months after Dyer announced plans to annex several thousand acres of land south of its corporate limits, St. John voluntarily annexed about 179 acres. The parcels, which line up east-west, essentially block off a portion of the area Dyer had hoped to annex. Dyer wants a judge to rule the annexation null and void.
Dyer Attorney Bill Enslen said he expects a prompt ruling by Pagano, likely within seven to 10 days.
Dyer Town Manager Joe Neeb did not attend the hearing, but said he would attend future court dates when he is needed to testify.
In December, the Dyer Town Council adopted an ordinance to annex more than 3,000 unincorporated acres, a move strongly opposed by residents living in that area.
