CROWN POINT | A civil lawsuit has been filed in Lake Superior Court by the family of Jamie Rodriguez, the Hobart teen who was severely beaten outside a downtown Hobart restaurant on June 4.
Named in the lawsuit are Brittney McCammon, 15, who is facing charges of attempted murder and felony battery in the incident, and her parents, Michael McCammon and Wendy Bullock.
Also named are David Robinson, Albert Hall and a minor Michelle Hernandez, along with her parents. Bajapantie, Inc., the owner of Lake George Shrimp, where the beating occurred, is also named as a defendant.
The lawsuit, filed by attorneys David Gladish and Mark Gruenhagen, alleges that Robinson, Hall and Hernandez convinced McCammon to attack Rodriguez and Hernandez enticed the victim to go to Lake George Shrimp as part of the plan. At the restaurant, Rodriguez became aware of the plan and sought help from employees, but was denied use of the restaurant's telephone.
According to the court document, Rodriguez was able to call her mother on a cell phone to pick her up, but workers at Lake George Shrimp told her to leave the restaurant when they were told about the confrontation. Rodriguez was told that her mother was outside and it was safe for her to leave, but she was immediately attacked by one or more persons upon exiting the restaurant. She was then continually attacked by McCammon.
Rodriguez's injuries were so severe she had to be airlifted to Loyola University Medical Center in Maywood, Ill. She was released from the hospital a few days later, but continues to face ongoing physical therapy and psychiatric sessions, according to her parents.
A Lake Juvenile Court magistrate has set a July 29 date for the pretrial hearing for McCammon, who is being held in the Lake County Juvenile Detention Center. The prosecutor's office is asking that the teen be waived to adult court.
No others have been charged criminally in the attack.
