INDIANAPOLIS | A House committee approved legislation Thursday allowing Lowell, Winfield and similarly situated Indiana municipalities to annex their water or wastewater treatment facilities, even if the property is not contiguous to the rest of the community.
State Rep. Rick Niemeyer, R-Lowell, said he sponsored House Bill 1273 to eliminate permitting delays caused by county government when municipal facilities are not contained within town or city borders.
"So when they want to do something with them, like put a building on or do updates, they can do it through their jurisdiction inside their plan commission, their zoning, instead of having to go through the county," Niemeyer said.
The legislation requires a water or wastewater facility currently exist to be eligible for annexation.
Properties between municipal borders and the annexed facility would not be eligible for annexation, Niemeyer said.
The proposal now advances to the full House.
