Two law firms are bringing a class-action lawsuit against BP Corp. North America seeking $5 million in damages on behalf of consumers who bought tainted gasoline from the oil giant in four states during the past week.

Cohen & Malad LLP and Theodoros & Rooth PC announced Friday they were filing the lawsuit in U.S. District Court in Hammond.

BP has acknowledged unknowingly shipping more than 2 million gallons of substandard gasoline from its Whiting Refinery to gas stations in several states. The faulty gasoline caused difficult starting and engine stalling. It since has recalled the gasoline.

The company has set up a hotline and procedure for consumers to reimburse them for car repairs. A BP spokesman Friday night said the company does not comment on pending litigation.

The class-action lawsuit being brought by the two law firms alleges BP sold defective gasoline starting Aug. 20 in Indiana, Illinois, Wisconsin and Michigan.

"If we've learned one thing from the BP oil spill, it's that BP cannot be trusted when they are both judge and jury of their own misconduct," said Irwin Levin, managing partner of Cohen & Malad LLP.
