CROWN POINT | Lake Criminal Court Judge Salvador Vasquez on Wednesday set Nov. 14 for what could be a last pre-trial hearing in the case of a hit-and-run accident that killed a county correctional officer and injured three others.
Jason Cozmanoff, 43, of Lakes of the Four Seasons, faces 13 felony counts of failing to stop after an accident that killed Correctional Officer Britney Meux, 25, and severely injured three fellow officers as they jogged along 93rd Street about 7 p.m. on March 6, 2012.
Cozmanoff's trial is set to begin Dec. 2.
A previous trial ended in a mistrial in June when a member of the jury pool informed the court he had witnessed the accident with as many as 30 others who were looking out the window of the Lake County Work Release Center across the street.
None of those in the work release program had told police about seeing the incident during the investigation by the Lake County sheriff’s police.
The new information was shared with the defense and prosecuting attorneys after the jury had been empaneled.
“It would be manifestly unjust to require this case to go forward,” Vasquez said at the time in granting the defense request for a new trial date.
An appeals court likely would have reversed any guilty verdict, if that had been the outcome, and ordered the case tried again, he explained at the time.
