CROWN POINT | A Lake County police officer sued a local McDonald's alleging an employee spit on his chicken wrap and dropped it on the floor.
Officer Michael Buehrle, of Crown Point, was off duty when he bought a chicken wrap April 2 at the drive-thru at a McDonald's at 10885 Randolph St. in Winfield, according to a complaint.
Buehrle observed the employee spit on the order, drop the food on the floor and laugh about it with a co-worker, according to the complaint.
When Buehrle entered the store and requested a refund, the store manager agreed only if he returned the wrap, which he did. When Buehrle identified himself as an officer and asked for the name of the employee who spit on his food, he was refused the information, the complaint states.
When uniformed police arrived, employees and the manager would not immediately come to the door, the complaint states.
The suit argues the store failed to take steps to protect its customers, breached the duty of care owed the customer and acted with reckless disregard.
The suit seeks the payment of compensatory and punitive damages and costs.
Media officials with McDonald's did not respond Thursday to calls for comment.
