CROWN POINT | A divorce hearing for murder defendants Riley Choate and Kimberly Kubina is set for Dec. 20 in Lake Circuit Court, court documents show.
Besides murder, the estranged couple face a plethora of charges in connection with the death of Choate's son Christian Choate, 13.
The boy's body was found in May buried in a shallow grave in a mobile home park in Gary's Black Oak neighborhood. He is believed to have died in April 2009 after several years of severe abuse.
Choate, 39, filed for divorce Aug. 5 without benefit of an attorney, court records show.
Kubina, 45, was served five days later in the Lake County Jail, where the couple are being held without bond. A bail hearing for each is set for Sept. 8.
According to court filings, the divorce hearing will take place Dec. 20 before Lake Circuit Court Magistrate Michael Sarafin.
