HAMMOND | The U.S attorney's office filed a motion Monday to dismiss four drug-related charges against a former Gary police officer, court records state.
David Finley Jr., of Merrillville, was indicted in September after the FBI alleged he sold cocaine to an undercover officer, according to a criminal complaint filed in August.
Prosecutors filed a motion Monday to dismiss two counts of distribution of cocaine, possession with intent to distribute cocaine and possession of a firearm in furtherance of a drug trafficking crime, court records state.
The motion did not give a reason as to why prosecutors are moving to dismiss the charges.
Finley still faces several charges in the original indictment, including making false statements during the purchase of a firearm, sale of a firearm to a prohibited person and distribution of marijuana.
Officials alleged Finley bought a 9 mm handgun from a Gary gun shop and then sold it to a person who wasn't allowed to have a gun.
A trial has been set for 12:30 p.m. Jan. 22 before U.S. District Judge Joseph Van Bokkelen.
