GARY | The family of a Gary teenager has agreed to settle claims the girl was sexually molested two years ago in her public school classroom by other students.
Merrillville lawyer R. Brian Woodward, an attorney for the now-16-year-old girl's family, said Friday they will dismiss the suit against the Gary Community School Corp. in return for a payment of more than $22,000.
An attorney for the Gary Community School Corp. didn't return a call Friday seeking comment.
The girl's family claimed last year in a U.S. District Court lawsuit she was a student at West Side Leadership Academy in Gary on Sept. 13, 2011, when she was assaulted during a fifth-period class in the presence of about 30 other students.
The suit alleged the teacher had turned off room lights to show a movie about dinosaurs and then left the room unsupervised. It alleged two male students dragged her to the back of the room removed some of her clothes and fondled her until the bell sounded the end of the class period.
The school denied the allegations and the proposed settlement filed this week in court states the payment isn't any admission of fault.
