CROWN POINT | A jury heard opening arguments Tuesday in the homicide trial of a Gary man.
Jory D. Peters, 27, is pleading not guilty to charges he fatally shot Juan Nieves, 21, of Gary, in a drive-by shooting Aug. 7, 2011, near 25th Avenue and Washington Street in Gary's Midtown section.
Police say a relative of the victim saw Peters and another man in a car following the victim's car. Police say Peters opened fire on Nieves, who died of multiple gunshot wounds.
Police said Peters claimed he was under fire, too, although officers found no evidence that Nieves was armed at the time or that Peters' car was damaged by gunshots.
