HAMMOND | Hammond and Chicago Heights are asking for more time to file a motion to dismiss a lawsuit addressing the Illinois community's water rate, federal court records show.
While the settlement is now in writing, the communities are asking for two additional weeks to give time for “the public processes required for formal approval and execution” of the documents, according to a motion filed Thursday in federal court.
Chicago Heights sued Hammond in federal court over the proposed rate increase.
Hammond Mayor Thomas McDermott Jr. previously confirmed the communities had reached a verbal agreement for Chicago Heights to pay an increased rate of $2.20 per 1,000 gallons. TJ Somer, Chicago Heights corporation counsel, declined comment Thursday until he's able to review the final documents.
The communities also requested the stay a federal judge issued in the case in November to remain in place, according to federal court records.
