HAMMOND | The sentencing for disgraced former Hammond megachurch Pastor Jack Schaap should proceed as scheduled later this month despite requested delays by federal prosecutors, Schaap's defense attorney argues.

Defense attorney Paul Stracci made that argument in documents filed Monday in Hammond federal court.

In a separate filing Friday, prosecutors asked U.S. District Judge Rudy Lozano to delay Schaap's scheduled Jan. 15 sentencing at least another 45 days for the government to determine victim restitution in the case and respond to Schaap's objections to sentencing recommendations.

Schaap, the fired former head pastor of the First Baptist Church of Hammond, pleaded guilty Sept. 26 to having sex with a 16-year-old church girl.

Since that plea, the government has had sufficient time to calculate restitution and the Jan. 15 sentencing should proceed as scheduled, Stracci's filings state.
