HOBART | A Hobart construction firm owner pocketed a customer's down payment and then didn't complete a home improvement project as promised, police said.

David L. Ferner, 47, of Hobart, was charged Tuesday with one count theft and two counts of home improvement fraud, Hobart police said.

A resident in the 2700 block of West 65th Place contacted police in regard to a work contract not honored by Ferner, owner of Alligator Construction of Hobart, court documents state.

The contract price was $1,000, and the resident told police he paid $500, as requested, to start the home improvement project, court documents state.

The work, which was to begin the week of Jan. 16, was never started, and a refund was never provided, court documents stated.
