SCHERERVILLE | A 33-year-old Gary man allegedly fell asleep behind the wheel of a car that was running and in gear to drive.
About 3:20 a.m. Sunday, Schererville police were sent to an access road between the Deer Run and Fox Run plazas near U.S. 30.
Inside an Oldsmobile, police located a male driver, who was later identified as Davion Allen.
Court documents state Allen was asleep in the vehicle, which was in the middle of the road, and his foot was firmly on the brake pedal.
Police detected an odor of marijuana and an "alcoholic type beverage" inside of the car, the documents state.
Police didn't want Allen to wake up and press the gas pedal, so an officer got in through the passenger side of the car, put the car in park and removed the keys from the ignition.
After Allen woke up, he appeared to be intoxicated, court documents state.
Allen allegedly couldn't answer when asked to provide his name.
Police indicated Allen required assistance to get out of car, and he couldn't stand without support.
Allen refused to take a portable breath test. He also declined to answer questions, court documents state.
After a canine unit examined the vehicle, police located a small bag of marijuana in the armrest of the vehicle and a large bag of marijuana in the trunk, according to the documents.
Inside Allen's wallet, police located two credit cards that didn't belong to him, the documents state.
Allen told police the cards belong to relatives.
Allen was charged with felony possession of marijuana.
