LAPORTE COUNTY | No charges will be sought against a LaPorte County man who fatally shot a burglar inside his home.
LaPorte County police reported Wednesday the case was closed with no charges being pursued.
Jason Rabe, 23, of Three Oaks, Mich., was killed when shot in the chest July 8 inside a home on County Road 1000 North near Hesston.
LaPorte County Prosecutor Bob Szilagyi after reviewing all of the evidence gathered from the investigation concluded Stephen Penny, who was renting the home, acted in self-defense.
According to police, Penny heard glass from a window break and grabbed his gun then spotted the intruder in the utility room.
He shot Rabe during a physical confrontation. Rabe was holding a hatchet, police said.
