VALPARAISO | A Starke County man was arrested Sunday night on a drunk driving charge after a case of beer fell from the hatchback of his vehicle and nearly struck a police car.

An off-duty county police officer said he was behind a Toyota Yaris at 11:46 p.m. in the southbound lane of Sturdy Road at U.S. 30 when the traffic light changed green and the vehicle accelerated quickly causing the rear hatch to open and one of two cases of beer to fall just short of the front of the police car.

The officer said he approached the driver, Eric Marcyjanik, 41, who told him he was leaving a friend's house in Valparaiso where he had consumed five or six beers.

Marcyjanik reportedly told police, "My life is in your balance." He explained he was in nursing school and feared he could be kicked out.

Marcyjanik, whose blood alcohol content was measured at 0.10, faces a drunk driving charge.

When police returned to the site to recover the fallen case of beer, they found "a concerned citizen must have already removed the road hazard."
