VALPARAISO | A Valparaiso man pleaded guilty Friday to a reduced charge of sexual misconduct with a minor on allegations he had sex at least twice with a 14-year-old Boone Grove Middle School student while he was working as janitor at the school.
The proposed deal calls for Kevin Abernathy II to be sentenced to three years behind bars with all but time served and 60 days suspended. The 60 days will be spent on community service and the balance of the time on formal probation.
The 21-year-old also will be required to undergo HIV testing and complete sex offender and mental health treatment if the deal is approved by Porter Superior Court Judge Bill Alexa on Oct. 18.
Abernathy made the unusual move Friday of pleading guilty during his initial court hearing.
The accusations came to light after Abernathy voiced concern about his actions with two of his fellow custodians, police said.
He reportedly told police he met the girl at a bonfire a year earlier and the girl said she told Abernathy she was 15, police said.
The girl told police Abernathy approached her on Facebook and she agreed to sneak him into her bedroom.
Abernathy sneaked into the girl's bedroom three times during the late night between February and March, and they had sex during two of those visits, police said.
The girl said one of Abernathy's friends contacted her in April saying if Abernathy ends up in jail, she would end up in the hospital, police said. The man also reportedly said if police contacted her, she was to not to say anything.
