VALPARAISO | A Valparaiso man is accused of having sex on two occasions with a young relative as part of a fabricated story about protecting her from being blackmailed for an earlier sexual encounter with a boy.
Jeffrey Zbyrowski, 41, faces two Class B felony counts of rape, two Class C felony counts of incest and two Class D felony counts of criminal confinement, according to Valparaiso police.
The girl told police that after Zbyrowski discovered she had sex with a boy in November 2012, he claimed on June 1 he received a telephone call from an unknown male claiming to have a video recording of the encounter, according to the charging information.
Zbyrowski claimed the caller was threatening to release the video recording to pornographic websites unless the girl agreed to have sex with a virgin, police said. While the girl did not believe her sexual encounter was recorded, she insisted the caller be allowed to release the alleged video rather than comply with his demands.
Zbyrowski, claiming to be interested in protecting the girl's reputation, arranged for the encounter, police said. He allegedly blindfolded the girl, bound her wrists to her mattress using zip ties and claimed to leave the house to allow the stranger to have sex with her.
The girl said a man entered the room, had sex with her and remained silent when she asked, "Why are you doing this," according to police. When the man left, she ran to the window, but saw nothing before calling Zbyrowski to return home.
Zbyrowski then claimed a month later on July 1 the man called again and felt bad the girl was shaking during the first encounter and wanted to make it up to her by offering money this time, police said. A second encounter was allegedly arranged by Zbyrowski and carried out with $50 being left behind.
The girl told her friend in August about the encounters and after another relative of the girl learned about what happened, police were notified.
Police said Zbyrowski initially denied knowing anything about the encounters, but then admitted to setting them up to, "teach (the girl) a lesson about making bad decisions regarding having sex with boys." He said no one actually entered the house and had sex with the girl.
After undergoing a voice stress analysis test, Zbyrowski admitted he was the person sexually assaulting the girl, police said.
The case has been assigned to Porter Superior Court Judge Bill Alexa, and an initial hearing is expected next week.
