VALPARAISO | The young woman told a jury Tuesday the Hispanic man who brutally attacked and raped her four years ago after breaking into her Valparaiso apartment repeatedly apologized during the incident.
He also complimented her about the beauty of her nose, asked her at one point if she was interested in watching a movie and expressed concern when she complained about the pain of landing on top of an overturned wall cabinet.
When the rape was over, she said he turned her on her side and covered her partially with a blanket.
"He told me to go to sleep, it's going to be OK," she said.
Prosecutors say the man responsible for the conflicting behaviors is Arturo Garcia-Torres, an illegal alien from Mexico who was sitting just a few feet away from his alleged victim as the evidence portion of his trail got under way Tuesday before Porter Superior Judge Roger Bradford.
The 21-year-old is charged with felony counts of rape, attempted rape and two charges of burglary.
The described rape occurred July 18, 2004, at an apartment on Homer Court and the attempted rape occurred June 12, 2005, at an apartment on Garfield Street, both in Valparaiso. The attacker got away in both instances, but police recovered a shoe and cell phone they believe to be linked to the crime.
Deputy Prosecutor Cheryl Polarek said she plans to present DNA evidence this week linking Garcia-Torres to the crime.
Defense attorney Visvaldis Kupsis told the jury Tuesday the charges against Garcia-Torres are based on a hastily done investigation by a police department under pressure to find the person responsible for the high profile attacks on the Valparaiso University students.
He said the victims' initial descriptions of the attacker are of an older and larger man than Garcia-Torres. The cell phone in question was recovered several blocks away and in the opposite direction of where the attacker reportedly fled, he said.
The woman who testified Tuesday retained her composure as she described how the man pushed his way in through her apartment door and proceeded to strike her and drag her throughout the apartment.
"I was fighting as hard as I could to get away," she said.
She said the man spoke to her both in English and what she believed to be Spanish.
