...Drivers driving along a road with homes and driveways should be aware that at one point or another a car may be backing out. This is why there are posted speed limits. One can't always see everything while he or she is backing out. It's up to both parties to recognize that possibly one person may not see the other. This is why we drive cautiously. AND also why you see so many cars stomping on their brakes at the last minute while backing out. If he had the reaction time or the proper speed (not insinuating he was speeding, I haven't seen the police report obviously) he could have recognized this.
