  1. The "railroad police" (ie. NICTD) are there to protect the interest of the railroad. Those interest being the destruction/theft of their (NICTD) property (ie. copper cable, facilities, rail lines, money at the station, etc.) They are under no obligation (legally) to protect the riders. You ride the train and use the facilities at your own risk.

    Look up "Warren v. District of Columbia" in google/wikipedia and you will see that the courts have held police do not have a duty to provide police services to individuals.

    There is no legal duty to "protect and serve" an individual. They are paid to protect the interest of the railroad.

  2. @4NRA - It may be a misdeamer in IN but it's a felony in IL, assuming that is where the guy is from. So you are advocating that he break the law in either case. **SIGH** Wow! total fail.

  3. The Big Giant Head summed it up. In IN you can NOT just pull out a gun and/or fire it "just becuase". There must be a valid legal reason. Pointing a firearm (loaded or unloaded) at anyone in IN is a crime (a felony is the gun is loaded). IN law does allow one to use "deadly force" of which shooting a firearm is considered deadly force in a very set of narrow circumstances.
    - to stop the commision of a felony
    - to stop bodily harm/los of life (ie. the guy slashing your throat)
    - to protect someone who's life is in danger of loss

    In your case above if you fend off the knife guy you CAN NOT legally go after him (ie. he is running away) nor attempt to shoot his as he is no longer a threat attempting to do the 3 items I listed above.

    Yes, technically you can shoot him or attempt to shoot him as he runs away but now you yourself are committing a crime as that act is not lawful anymore.

  4. Based on the article there was no one else around expect the victim and the guy with the knife. So how could an innocent bystander have been hit by a bullet if a gun would have been used?

  5. There is an NICTD police station at the EC station but officers are rarely seen even during rush hour times. NICTD is more concerned with the theft of the copper in the cable lines and damage to their equipment than passangers and/or their cars/personal items. About the only time you will see NICTD police is when an intoxicated person is being kicked off the train.

  6. @blueman, the victim was in a car with IL plates which means he was probably an IL resident which means he ccan NOT get an IN handgun license (ie. not a resident of IN) and the state of IL does *NOT* allow its citizens to carry handguns via a permit/license. So legally this vicitm had no way to defend himself with a gun.
