Unless the schools are private schools, and the terms are spelled out for admissions to the schools, the drug testing is not legal. All schools, unless private of course, are public schools and therefore your constitutional guarantees still apply.
Your argument that there won't be any successful lawsuits is plain B.S. The schools are allowed to adopt certain policies and procedures to ensure the safety and welfare of students and staff, as long as it does not violate constitutional protections. Regardless of whether or not you state that they will or will not be punished for the drug test, the fact remains that you CANNOT make it mandatory for them to participate under NORMAL conditions.
If it is a requirement for them to participate in extracurricular activities, that is something completely different.
How about a federal civil rights violation? What happened to the 4th Ammendment to the Constitution which states:
AMENDMENT IV
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no warrants shall issue, but upon probable cause, supported by oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.
I see nothing but lawsuits coming out of this, if he moves forward!!!
