  1. Does not mean they will win the appeal. The change Of venue is there only motion to correct error and good luck getting appeal court to overturn that. Plus do these attorneys really want to do more work when there probably not getting paid? Will they ever do another trial-- doubt it. They don't care about mccowan. Don't fall for those comments of "we will appeal" " we will keep fighting for mccowan " they don't want to do more work.

  2. I'm a good friend of the attorney that filed the lawsuit-- the issue is simple. If someone's takes a duty to protect someone and negligently does than that's considered a issue of fact for the jury to decide. The court of appeals were affraid that this law would cause insurance company's rates and policy's to go up and we all know insurance company's run this country. Secondly, do you ever ponder why they protect the cars with netting in the parking lot but not the patrons? Indiana does not have any law on this issue and the defendants used law from other states that were 60 years old-- it comes down to one issue, if they take the duty to protect, it must be done without negligent-- leaving a three foot gap so they can throw t shirts to their fans-- is enough for the trial level to deny there motion for summary judgement. However this is far from over, I'm sure they will file a transfer to Supreme Court and the Supreme Court will get the decision correct and it will eventually be heard and the appeal court will be over turned.

  3. He will have to testify-- most likely as adverse witness for the state. He is the one the gun was registered to and he's the one who said the gun was missing. When did it go missing? That day? Only he knows.

  8. Indy-- the motive is new news to most of us and I believe this helps the state. However, in sure we can all agree that there were others involved , in helping hide the crime scene or maybe was this all an accident?

    The bigget question I keep pondering is --- where is all the blood? Wouldn't there be blood where she was dragged? Also the orange shirt with her blood( was it a male size? Was it wheeler bearcat shirt?--was he wearing that shirt and when he drug her is that how blood got on shirt?-- where exactly was the orange shirt found?)

    Please give me everyone's thoughts.

  9. pockc- not its not but im playing devils advocate here. Is it better to put a guilty person on the streets or innocent person in jail?

    Science does not create errors--- Humans do! So if were convicting a young kid on humans hearing and seeing things and not science-- than I can not see the jury convicting him.

  10. The reason for the neighbors testimony of what she hears, is the story the prosecution is portraying to the jury. There giving a timeline of the events and placing mccowan at those places at the time his cell phone was GPS. Its the timeline of all the events that the prosecution wants the jury to hear, but since they do not have hard physical, direct evidence, the only way to convict him is to show circumstancial evidence and place mccowan at the places where all these events happened.
