ORDINANCE NO. CC-2021-2041 COMMON COUNCIL OF THE CITY OF WHITING, INDIANA AN ORDINANCE OF THE CITY OF WHITING, LAKE COUNTY INDIANA, AMENDING WHITING MUNICIPAL CODE SECTION 16-76 SCHEDULE OF WATER RATES AND CHARGES AND ALL PREVIOUS ORDINANCES APPLICABLE THERETO WHEREAS, on or about September 7, 2010, the City of Whiting and the Hammond Water Works Department (“HWWD”) entered into a purchase agreement wherein HWWD agreed to provide the City and an adequate supply of potable water and the City agreed to purchase same; WHEREAS the Common Council of the City of Whiting adopted the current water rates and charges for its water customers on September 5, 2017 in Ordinance No. CC-2017-1969; and WHEREAS, on or about October 8, 2020, the City received notice from the Hammond Common Council regarding a public hearing on new proposed water rates for all the Hammond Water Works Department (“HWWD”) customer communities; and WHEREAS, on or about November 16, 2020, the Hammond Common Council adopted new charges for water under the potable water supply agreement between the HWWD and the City; and WHEREAS the initial proposed rates from the City of Hammond represented an increase for the cost of potable water to the City in an amount more than Three Hundred Fifty Percent (350%) over the current charge for the water; and WHEREAS, after the filing of a statutory objection and an action for declaratory judgement, the parties negotiated a settlement for new water rates to be charged by HWWD to its wholesale customer communities; and WHEREAS, the Clerk-Treasurer has reviewed the new costs for the purchased potable water and recommended new water rates and charges which reflect the increased costs to the City; and WHEREAS the Common Council finds that the proposed water rates and charges are fair, nondiscriminatory, reasonable, and just and that there is a financial need for the adjustment to the rates and charge; and WHEREAS, a public hearing will be properly noticed and held, all notices will be provided to rate payers in accordance with WMC Sec. 16.63 and notice of intent to consider this Ordinance will be published twice prior to final passage. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of Whiting Indiana, as follows: SECTION 1. Whiting Municipal Code Sec. 16-76A and 16-76B are amended and revised as follows: Sec. 16-76 Schedule of water rates and charges A. Generally. Effective January 1, 2021, the new rates for Metered Consumption per Month Basic Service Charge and the Minimum monthly charge for the use of and the service rendered by the waterworks systems of the city water utility, based on the amount of the water supplied during each monthly billing period, shall be as follows: Metered Consumption per Month Basic Service Charge Rate per 1,000 Gallons First 999,999 gallons $3.56 Over 1,000,000 gallons $1.75 B. Minimum charge.
