Hammond city worker catches wire thief in act, police said

CROWN POINT — An employee who was supposed to provide in-home care to a man with a autism instead beat him with a padded object because the man refused to eat his breakfast, according to court documents. 

Mario Wilson, 43, of Gary, was charged Wednesday with battery, confinement and neglect of a dependent, court documents show. Online records indicate he has not been arrested. 

The assault lasted about right minutes, based on video surveillance from the residence obtained by a detective, police said. The man sustained bruises to his neck and hands, documents show. Detectives did not find evidence the man provoked Wilson, according to information a probable cause-affidavit. 

Wilson sat with the man after he prepared him breakfast around 8 a.m. on Jan. 26 in a home on the 1700 block of 171st Street in Hammond. The man ate a few bites and after a few minutes, Wilson encouraged him to keep eating, according to video surveillance. The man refused and pushed the plate back toward Wilson.

Wilson told the man to go to his room and then said, "All right, you want to play with me this morning, all right," according to the affidavit.

The man walked into the living room and sat down, police said, and Wilson grabbed a padded kick shield, which employees use in the event patients get violent.

The video footage showed Wilson instruct the man to get up from his seat and the man became visibly and audibly upset, the affidavit said.

When the man eventually got up and walked toward Wilson, Wilson pushed him back into the seat with the pad and used "extreme force," police said.

He held the kick shield on top of the man's body, which prevented him from moving and possibly breathing, a detective wrote in the affidavit.

After Wilson released the kick shield, he attempted to instigate a fight and told the man to get up, police said.

The man remained seated for few more seconds. Once he stood, Wilson hurled himself against the man and struck him multiple times with the kick shield, the affidavit said. 

Wilson assaulted the man in front of another in-home care worker who failed to intervene, police said.

The other employee held the man's legs down at a few points during the assault, the affidavit said. She was not formally charged.

Wilson and the other employee were suspended from their place of employment pending an investigation, police said.
